Welcome to Draftify (the "Service", "Platform", "we", "us", or "our"), accessible via https://draftify.site, our official web dashboard, and our official IDE extensions. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Draftify regarding your access to and use of our software, developer APIs, command-line interfaces (CLI), and extensions.

By registering an account, purchasing credit, subscribing to a tier, or utilizing our infrastructure, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately cease all use of the Service.

1. Description of Service & Technology Disclaimer

1.1. Service Scope

Draftify provides a proprietary AI-assisted development environment, including code-generation chatbots, workspace indexing tools, custom developer APIs, and integrated development environment (IDE) extensions.

1.2. Infrastructure Transparency & Independent Operation

Draftify operates its own highly optimized software architecture, utilizing various state-of-the-art open-source and proprietary software models fine-tuned specifically for coding tasks.

  • Independent Entity: Draftify is an independent software application. Draftify is not affiliated, associated, authorized, endorsed by, or in any way officially connected with Anthropic PBC, OpenAI, Inc., Google LLC, or any of their subsidiaries or affiliates.
  • Model Classifications: References across our marketing materials to "Opus-class", "Sonnet-class", or "Fable-class" refer purely to performance tier benchmarks evaluated internally for logical reasoning and programming compliance. They do not imply that official, corporate APIs of third-party tech providers are being resold directly to you.

2. User Accounts and Verification

2.1. Account Registration via Whop

To utilize the Service, you must create an account and manage your access through our official merchant storefront on Whop (https://whop.com) ("Whop Dashboard"). You agree to maintain the security of your Whop account, as authentication, license key delivery, API provisioning, and access management rely directly on Whop's infrastructure.

2.2. Age Requirement

You must be at least 18 years of age to utilize advanced processing models, dynamic automated systems, or screen automation frameworks associated with the Platform.

3. Financial Terms, Billing, and Metering

3.1. Subscription and Usage-Based Models

Draftify offers flat-rate monthly subscription tiers as well as metered, pay-as-you-go / token-based API architectures. The exact rates for Input and Output tokens across different processing classes are outlined on our official dashboard and pricing pages.

3.2. Credit Systems & Prepaid Billing

For certain API features, a Prepaid Credit System may be enforced. Credits are purchased in advance by the User. As your custom scripts or IDE tools query the Draftify API, internal balances are depleted in real-time based on actual token processing volume. If your prepaid account balance reaches zero (€0.00), API operations will automatically suspend until additional credits are successfully deposited.

3.3. Payment Processing & Whop Platform

All financial transactions, payments, subscriptions, and prepaid credit additions are securely handled, managed, and processed through Whop (incorporating their integrated checkout systems and regional payment gateways). Draftify does not collect, store, or process your raw banking or credit card details. By purchasing a product, subscription, or token package via Draftify's Whop store, you also agree to operate in accordance with Whop's standard Buyer Terms and legal frameworks.

3.4. Hard-Cap Safeguards

To protect Users from unexpected financial liability resulting from local software bugs (e.g., local automated loops or script errors executing excessive queries), Draftify reserves the right to implement automatic soft and hard spending limits. Users may adjust these thresholds via their personal account dashboard.

3.5. Refund Policy

Due to the immediate, high-priority bare-metal compute costs required to fulfill AI processing loops, all sales of prepaid tokens, subscription fees, and software usage credits are strictly non-refundable unless required by applicable consumer law.

4. Intellectual Property & Code Ownership

4.1. Input Code and Prompts

You retain absolute, 100% ownership of all source code, software repositories, configuration files, prompts, and documentation that you feed into or analyze through the Service.

4.2. Generated Outputs

Draftify claims no intellectual property rights over the code snippets, refactored architectures, files, or modifications generated by our models. All output code belongs entirely to you, and you assume full responsibility for reviewing, testing, and verifying its accuracy prior to production deployment.

5. Privacy & Zero-Retention Policy

5.1. Scope of Data Ingestion

Draftify enforces a strict, infrastructure-level Zero-Retention Policy regarding your proprietary source code. Any code context, workspace files, or prompts sent to our servers are processed entirely in-memory to compile context and generate the requested response. Once the response generation finishes, the underlying input fragments and source snippets are permanently flushed and destroyed.

5.2. No AI Training on User Code

Under no circumstances will Draftify log, store, cache, or look at your code for the purpose of training future model checkpoints, fine-tuning neural weights, or optimizing shared software parameters. Your logic remains completely isolated.

6. Prohibited and Acceptable Use

You agree not to misuse the Draftify network infrastructure, developer APIs, or IDE tools. Specifically, you shall not:

  • Bypass, manipulate, or exploit any system limitations, rate limit boundaries, or fair-use guardrails established on our flat-rate tiers.
  • Use our infrastructure to generate software exclusively designed for malicious exploits, virus delivery, ransomware deployment, or illegal network intrusions.
  • Reverse engineer, decompile, or attempt to extract the weights, prompt-routing logic, or base architecture of Draftify's underlying hibrid system.

7. Limitation of Liability & Disclaimer of Warranties

7.1. "As-Is" Provision

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DRAFTIFY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2. System Executions & Local Actions

Draftify's IDE extensions and CLI tools are engineered to provide local system operations (such as creating directories, generating files, or running terminal actions). You acknowledge that all such activities are subject to local validation (Accept/Reject mechanics) within your IDE environment. Draftify shall not be held liable for any data loss, broken branches, system corruption, down-time, or unintentional script execution occurring within your local development workspace.

7.3. Cap on Damages

IN NO EVENT SHALL DRAFTIFY'S TOTAL LIABILITY FOR ALL CLAIMS, LOSSES, OR DAMAGES EXCEED THE TOTAL AMOUNT PAID BY YOU TO DRAFTIFY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE INCIDENT CAUSING LIABILITY.

8. Modifications to Service and Terms

Draftify reserves the right to adjust, update, or pivot its pricing frameworks, model offerings, and layout mechanics at any time. We will notify users of any substantial amendments to these Terms by posting the updated version directly to this URL. Continued utilization of our Service following such revisions confirms your acceptance of the updated terms.

9. Governing Law & Jurisdiction

These Terms, along with any disputes arising out of your utilization of the Platform, shall be governed by and interpreted in accordance with the laws of the country where the founding operations of Draftify are established, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the competent courts located in the primary business registration region of Draftify.
